I think this is doubtful as a plot point. I would assume that the Arkenstone's oath only holds for when a dwarf of proper lineage holds it, not necessarily when a thief takes it and gives it to somebody else. If that were the case, the dwarven armies would have been beholden to Smaug. If anything, it will only make Dain's (and his army's) wrath that much more intense, not to mention Thorin's anger at his betrayal by Bilbo AND the fact the Arkenstone is in the hands of his "enemies".

will probably have Thorin take it from Bilbo with force, full fight scene in minecarts. lol jks but in all seriousness, I think when Thorin sights the Arkenstone and its not in his hands you'll see him flip his lid to get it.
