Why would settlement of this litigation
potentially affect slot machines and theme parks, etc., but not future
development of the films? Is it because past litigation has already settled that
point?






WB's and NL's right to make films based (however loosely) on The Hobbit and LOTR through their licensing agreement with Zaentz is not in question in this litigation. So long as the filmmakers continue to pay the royalties they agree to, and not try to use material from works that they don't have the rights to (Silmarillion, Unfinished Tales etc.) there should not be an issue.

And what's the chance that Tolkien Enterprises
could win (which I sort of hope they do), but that they would settle for
stopping new exploitation of Tolkien's stuff (the aforementioned slot machines
and theme parks) but continue to allow the LOTR Online game, which has been
around for six years already, and it would be a shame to shut it down now.
(Although it would certainly free up a lot of my time. Crazy)




I assume that you actually mean what is the chance that the Tolkien Estate could win, not Tolkien Enterprises. Tolkien Enterprises is the former name of Middle-earth Enterprises, the division of Saul Zaentz's company that he set up to exploit his rights to Tolkien's work. Assuming that is what you mean, the short answer is, I don't know how likely that is. Wink However, my best guess is that there is a pretty good chance that that is exactly what will happen.
