If the Hobbit Pub has been operating openly (name and movie stuff) then why wd SZ be entitled to the excuse that it just wasn't aware of it until now? Shouldn't the burden be on the IP holder to protect its IP rights by due diligence?

You expect omniscience? How reasonable of you.

The rights holder is responsible for protecting its rights. That why they are taking this action. Where did we lose you?

If you ask me, that requirement can create huge injustices. In all fairness, the violator should be responsible for all costs. Let's say you're an average joe living on a modest wage. If you had written a book of your own creation, but it never sold or wasn't a success, I'm sure you'd change your mind if the same huge corporation stole your idea and made big profits from it. Are you saying you wouldn't then object to the cost of defending your rights against a bottomless pit of legal funding? If you want to root for the small guy, make the violator responsible and be consistent. The ability to see things from multiple viewpoints, and not just the emotional ones, really is a requirement for making fair assessments of justice.
