* The Government will introduce to Parliament tomorrow legislation to clarify who is a contractor and who is an employee as it relates to the film industry, not any other industry. (*whew*) * The Government will widen the qualifying criteria for the Large Budget Screen Production Fund to improve New Zealand's competitivenes for large movies such as The Hobbit. This includes an additional up to US$7.5m per picture subject to the success of the movies. If the movies do well they get up to $7.5m; if they don't, they won't. (No details were given on what 'doing well' means. Key also declined to specify what this additional money would cover, but I got the impression that marketing would be part of it.) * The Government and Warners Brothers have agreed to work together in a long-term strategic partnership to market New Zealand as a place to make movies. In addition, the Government will work with Peter Jackson to develop appropriately themed material to promote New Zealand to tourists (with this appearing on DVDs and other material); and will work with Time Warner to promote New Zealand across its studio and media outlets. John Key says this will maximise the leverage for New Zealand to promote itself throughout the world as a tourist destination as well as its goods and services.

Good that the employee/contractor thing is limited to the film industry only. The tax breaks seem to be something that are due to what the film brings to the country- if the film is successful, better for country/tourism, I would guess? WB could really be a great partner in helping the film industry of NZ grow. Wow, I have goosebumps from this news! I wish more people were up on my friend's list so I can jump around with more people :D

So I log on to theonering.net and see that there's no major news yet, and start browsing the forums. I've been browsing through some older threads on the forum for about an hour and as I read through one of them I started to see posts that seemed to indicate a meeting was going on and an announcement was imminent. Then I get to the posts about TH staying in NZ and I'm like wait, that news wasn't on the front page... it happened while I was reading the earlier threads! I can't believe a huge announcement happens on this website right under my nose! Oh and by the way I'm very happy that it's staying in NZ.

I kept refreshing the news on the NZHerald site and the NZTV site until I saw the news, woohoo. As a Travel Agent, I already knew that New Zealand was a key destination to promote. Heck, I'm a Kiwi Specialist through Tourism New Zealand. So the third point mentioned is rather awesome, the increased commitment to promote the country as a film and tourist destination. I guess I need to go write up my press release for the next Cruise to Middle-earth now.

I couldn't have imagined a better outcome! For once I think John Key and Co. have done good! They have offered an extra US$7.5million per film if they are successful (e.g. US$15 million total provided the films do well enough) and US$10 million extra towards marketing, which apparently will involve plenty of marketing that promotes NZ and an ongoing relationship with Warner Bros that will foster and promote the NZ film industry. The government is introducing legislation to further clarify the difference between contractors and employees. Through this insanely difficult process the New Zealand film industry may end up better and stronger than ever.

The first part is reasonable, I think - that part really needs clarification to avoid more of these union stunts. To limit that to the film industry is a sensible decision. And I hope the third part makes up for the second part. That way NZ gains something, even if they are giving in to the financial demands of Warner to a certain extend in the second part. That way all parties can sell it as a success for themselves Thanks for posting these details so fast!

I felt really nervous before John Key's press conference. I had a funny feeling he was going to say the movie was going off shore. So when he said the opposite I had a little dance around the room . Now, finally the movie can progress at full speed. It's going to be a fun and exciting couple of years.

It's reciprocal. Look at the merchandise and copies of the film, books etc that will sell through visitors to NZ, which will benefit WB as well ascthe country. I spent hundreds when in NZ three years ago, and have continued buying every version of the film as it's released as well. btw thrilled it's remaining in NZ and it's a fantastic deal for both parties.

it was pure Tolkien and absolutely nothing he didn't write. There is after all, Silmarillion, Lost tales and Children of Hurin but I'm guessing they would either split the Hobbit in two and then have the bridge movie or one Hobbit and the bridge movie split up.

So happy. I checked earlier this morning, but nothing. And then I get into work, check Facebook quickly, and the first 10+ entries are all on The Hobbit staying in NZ. I'm so happy. Haven't done a thing this morning then checking here, Facebook, reading along articles starting here and there and every where. Well done to all the folks in NZ. Great decision from WB! And good luck to everybody who is now going to be extremely busy with all the work (if you need a hand *hint, hint*)! Off doing another geeky Hobbit-dance.

I am so relieved that a deal has been done - and one that isn't too outrageous in terms of just handing WBs a lump of cash. Sure $25m US isn't chickenfeed, but in the context of what was at stake - a most reasonable outcome imo

I'd have pushed for both! It makes a lit more sense. The publicity New Line gained from the way NZ celebrated tbe RotK, more than made up for the 'inconvenience' of being premiered in NZ.

I would think it would be the second one, wasnt ROTK the one with the big Wellington premiere. I should know, I was in the crowd, but I have completely forgotten when it was I still have some photos I took of the procession from back then.

Thanks, it came to me as I got sunburned sitting on a hill waiting for the Warners plane to fly in wishing I was at the rally. No plane but we did order Hell pizza. The guy who delivered it climbed a cliff face just to get it to us... very impressive. Will upload to youtube when I get a moment... Typical my one day off this week and it all get resolved... not that I mind the outcome... sorry just lots of happy random rambling going on here. As a fan I'm geeked to the max about it. As a film and TV worker it gives me real hope for our industry. As a Kiwi it make me proud we found a way through. YAY!!!

have not only endorsed and proven their faith in NZ, but they've gone a step further with this: "The Government and Warners Brothers have agreed to work together in a long-term strategic partnership to market New Zealand as a place to make movies." I think WB is proving to be a company with a heart and arent' afraid to be more than a place that just does the business... they're completely boggling me in all of this. I'm so impressed.

Just to think that a month ago we didn't have green light, we didn't know whether PJ was going to direct or Freeman be able to fit it in his schedule or where it would be filmed. And now we have all the right pieces together and it looks perfect! :) (Well I could grumble on about the 3D and how I fear WB's marketing will look cheap but hey, this is a day for celebration and if I've learned anything during these years as a fan, it's to trust Peter.)

Everything seems to be just...good news now. Remember way back when ( a few hours ago) everything was gloom and doom? Congrats on being the first to post Martin Freeman idea on TORn! The first time I heard him and a few others mentioned for Bilbo was on IMDB, so at that time (2008) I checked them out and right away I knew that Freeman was Bilbo ... Now I can breathe knowing he will be playing the part. I had posts removed because I had too many pics of Freeman showing how much he looked like a younger Holm. When I checked out his acting the real light bulb moment came, as I recall seeing him in Love Actually, especially one of the last scenes where he jumps off the steps and walks to his left...it was Bilbo without hairy feet! I could not understand why most people in polls were favoring McAvoy...maybe because he was more well known in the movie industry?..but he looked and acted nothing resembling Bilbo. Anyway this is a good day to celebrate...!

You really believe that this agreement to "strategically partner" with the NZ government is some kind of major concession which shows they have heart? I am pleased that these films will be made in NZ, and I am happy that all the Kiwis who feared for their jobs will keep them. However, the cost of doing so was, IMO, unacceptable. I think the NZ governemnt should have driven a much harder bargain. They capitulated in a way that is nearly unforgivable.

There's a right way and a wrong way to go about achieving one's goals. The wrong way has severe consequences. But this deal is, in fact, good news, considering the long-term benefits that producing The Hobbit in New Zealand will have for the country. Without the current sacrifices, the long-term viability of the NZ film industry would have been in severe jeopardy. Now the industry will be safeguarded for the future, at a cost to those who put the industry in harm's way to begin with -- that's the risk of empowering individuals to speak for a group. So yes, people are celebrating. Having The Hobbit in NZ is, obviously, a matter of national pride. Today is not the day to rain on the parade.

NZ actors will be paid way above SAG minimums on The Hobbt. The average weekly wage I heard for Kiwi actors that signed contracts is $5,000. And for the first time in decades Warners are offering NZ actors residuals. The change in the law is about a clarification of the difference between a contracted worker and an employee to reduce the risk of future potential lawsuits. Don't forget that all of this only came about as a result of the MEAA blacklisting The Hobbit.

What happy happy news !! Congratulations to all who worked so hard to keep The Hobbit in Middle Earth /New Zealand where it belongs !! I am so very happy for all the Kiwis who devoted their time and hard work to keeping these films in their home country. This makes me very happy for Sir Peter and Fran and Philipia as well ! As I said, I am happy that this will be filmed in NZ. However, it is not a "happy day" for everyone. Particularly those Kiwis who feel their democracy has been subverted by a corporate entity that issued bold threats to extract a change in NZ law. I am not being a downer to be a downer. I am being a downer because for all our delight at our little film getting the greenlight, the implications of this decision, for NZ workers, is huge. NZAE and MEAA may have committed one of the worst tactical blunders in union organizing history. The stupidity of it astounds me. However, ultimately, it was Warners who strongarmed the NZ government, and I am least happy with them.

And why, exactly, do you assume I am NOT a Kiwi? I know plenty of Kiwis who are either not Tolkien/PJ fanatics, and who frequent other Tolkien-related messageboards, that are appalled by this decision. Most are happy to have the film stay in country, and wanted it to stay in country, but are aghast at the degree to which the NZ government bent over backwards and further reduced the rights of workers. In terms of basic human rights and employment protection, the NZ government just took a big step backward, and I'll be darned if I'm going to do a jig and purchase party favors in response.

I am so happy that this decision has been made It is truly amazing news. Without the passion, dedication and work ethic of the NZ filmmakers LOTR wouldnt be what it is and it is essential for the hobbit to be the best it can possibly be with that same team behind it. Another confirmation that the movie is moving forward. Interesting that keeping it in NZ has garnered a larger and overwhelmingly positive response while the green light was so so. Perhaps keeping it in NZ was more important than actually making it? Anyway, I digress. Super happy that we're closer to making these things. Happy that they can stay in NZ. Concerned about some of the dealings related to worker's rights, I'm interested to see how it plays out. If I had a 100 thumbs they would all be up!

It seems to me that NZ will benefit from this, even with the cost to them - the tourism and marketing they get from the movies will be worth more than they have to pay, methinks. I'd be interested to know the thoughts of those in the industry about the 'independent contractor vs employee' thing - but as one who works in the arts, I know that being an independent contractor often benefits me and allows me greater freedoms. Meanwhile - what I care about right now is that we will get to see THE SHIRE again!! Cannot WAIT to see those Matamata sets again! Hurrah hurrah hurrah. So pleased for PJ, for all at Weta, for NZ and for US! Can't stop smiling...

I may side with a union or I may not. This is a case where I wouldn't have sided with them, and it doesn't have to do with the fact that I want these movies made. The already mentioned extenuating circumstances all through this drama would have put me against this union action. Each event should be decided upon due to its individual merit.

I too would like to see some links - as well as some that prove that Warner's are in fact going to underpay the workers of NZ. Oddly enough, from the dozens of articles I have read, it seems the workers on The Hobbit will be paid way above the minimum requirement, with many many amazing benefits. Strange that through all of my reading, I have failed to find all the different articles you've apparently been reading claiming the exact opposite. I would love to see the proof you have! Also, it is within the film industry of NZ that will have a clarification of what makes one an "employee" or "contractor." Seems to me this does not undermine any worker of New Zealand's rights or is a "step back" in progress for the labor laws of NZ. Seems to me that it is rather a protection of rights for both types of workers within the film industry. Maybe you can give me some more insight, specific links and articles that will prove to me otherwise. Until then, I see you like many on these boards do: a nay-saying dissenter. I don't see any value or proof behind your arguments - simply negative statements with nothing to back them up. I will put more thought into what you say when you can show me all of the links, articles, and reasons that prove Warner's strongholded the NZ democracy to reduce labor laws so they can get away with treating their workers like slaves. I have seen absolutely not one shred of evidence for this belief.

Unfortunately I had tons of research and shadowing with my advisor this morning starting around 6AM so I could not take part in the vigil or celebration early this morning! But I checked around 7AM on my phone and squealed with absolute joy! This is incredible news, for us, for Peter, for the crew, for everyone in NZ, and for Warner Bros.! I am very keen to celebrate tonight with a bottle of champagne, just like the rest of you folks I am so looking forward to the coming months and years ahead, and I am excited to continually support Peter and all the crew through all of this!! You really believe that New Zealanders on this booard capture the entire NZ people? No, of course I don't - but I've been reading round all the news websites I can find and the view from the New Zealand media is overwhelmingly positive. I also know some people in New Zealand who have been very anxious and are celebrating today - and since John Key was so determined to persuaded Warners to stay - within the perameters of what was reasonable and what his country could afford - I have to assume that he thought the majority of his country would be behind him. If they're not, I'm sure they'll let him know.
And why, exactly, do you assume I am NOT a Kiwi? I guessed that you weren't from New Zealand because in a post you made in the last few days you said you knew nothing whatever about New Zealand employment law before all this blew up. Also your phraseology in previous posts about what you think New Zealand should do reads like an outsider's view. And I noticed that you spell labour without the 'u', which is something I associate - perhaps wrongly - with American spelling. If I'm wrong on any of these counts please accept my apologies.

that I haven't had the time to go through all of the information and read all of the posts... and I am admittedly ignorant when it comes to the legalities and implications. I stand corrected and am sincerely concerned with any fallout from this that harms the industry and the workers..... but I'm still happy at Warner Bros decision to keep the films in NZ.

How do we know even that? Anyway, the principle behind GM's comments is sound, that it is an affront to the people of NZ (or any sovereign nation) that an offshore corporation should be able to elicit changes to law in their country. In fact, that was a key complaint levelled at the offshore unions in all of this, that they had no right to meddle in NZ labour law or to demand changes to the industry practice. So on that basis, and in this very narrow sense, I agree with him/her, American or otherwise. Things that make this more palatable for me, and I suspect, many NZers are: the change to law appears to be limited to The Hobbit production; the apparent lingering confusion about rights of employees vs the rights of contractors and the very definition of either seems to be cleared up; it appears that a long term commitment towards NZ is being made by Warners (and assuming it is not exploitative by nature, this is a fairly progressive pledge on their part); and finally, everyone seems to have come through this, in NZ anyway, with their dignity intact. The sum result of the negotiations is laudable, imho, but that does not mean it does not warrant finer scrutiny. Whether this is the time or place for such scrutiny, on anyone's part, is a separate issue. There seems to be a lot of goodwill behind the decisions taken. On that basis, and for the sake of The Hobbit finally moving forward, I am more than happy to take a wait and see attitude. As AL said, frowns upside down, all around!

Where capital will move to the cheaper labour, and where labour flows to meet the capital, such adjustments will occur in order to achieve the best outcomes. This is one of the cruxes of the anti-globalisation argument - preventing this freedom of exchange or at least trying to ensure it occurs to the benefit, rather than detriment, of people (as opposed to the capital). This is a phenomenon which is occuring throughout the first world, as capital seeks cheaper labour - hence the rise of China at the expense of US workers, as just one example. The smart money for the next (and last) cheap global labour pool will be Africa - so start investing now. Further along, it has been suggested that the present first world will cyclicly become the cheap labour force for what is now the second world i.e. cheaper UK workers will be manufacturing luxury cars for wealthy Chinese. In this instance, the capital had the choice to take its ball and leave the playground unless NZ chose to play by its rules. Thus NZ has done. To berate NZ for capitulating or bending over is to minimise the fact that Warner Brothers had other options and would have exercised them, resulting in the NZ film industry remaining principled, but unemployed. But it is not entirely one way. In industries where the capital is fixed, such as health, the labour moves to meet the money i.e. NZ doctors leave for Australia and better pay and conditions there. The doctors are taking the ball and leaving the playground. Unless one is able to change the fundamentals of the global system, this sort of paradigm clash and its outcomes are seemingly inevitable.
